1 BASIC PROVISIONS

    (1) The following terms and conditions apply to all the contracts, which you conclude with us as a supplier (hereinafter: “Be sCool” Kft.) via the www.belmil.de internet platform (hereinafter: website). Unless otherwise agreed, the inclusion of your own conditions, if any, is contradicted, unless Be sCool Kft. has expressly agreed to their validity in writing.

    (3) By placing your order, you agree to the General Terms and Conditions valid at the time of the order. You have the option of viewing the General Terms and Conditions as part of the ordering process, printing them out and saving them in a reproducible form.

    (4) A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

     

    2 OFFER

    (1) The products, their prices and special offers on the website cannot be considered as offers. The offer is created with a calculated offer after the product is placed in the cart, immediately before order. This offer includes discounts, shipping costs and other (not hidden) costs.

    (2) Images in the online shop are for product presentation purposes only and do not constitute a legally binding offer from Be sCool; changes and errors remain reserved.

    (3) If the buyer sees data on the website that differs from the realistic market assessment and can probably be attributed to a technical error - especially the suspiciously low price (e.g. 1 euro), the seller may reject the order after informing the buyer, and refund any amount paid within 5 working days. From the prices shown on the website, the seller is entitled to provide the customer with an individual discount after consultation, within his own authority.

    (4) All product prices include VAT. The prices stated are end customer prices plus shipping costs if applicable, which are clearly communicated to the customer in the shopping cart and on the order page at checkout. The customer receives an invoice with VAT shown.

    (5) The shipping costs are not included in the purchase price. They can be viewed on the Shipping information page on our website or in the respective offer, and are shown separately in the course of the ordering process on checkout page after filling out the shipping address and are to be borne by you in addition, unless free delivery has been promised.

     

    3 CONCLUSION OF THE CONTRACT

    (1) The subject of the contract is the sale of goods.

    (2) Primary language of the contract is German, but the customer can ask it in english form via e-mail to info@belmil.de

    (3) We do not save the full text of the contract. Before sending the order, the contract data can be printed out or saved electronically using the print function of the browser. After we have received the order, the order data, the information required by law for distance contracts and the General Terms and Conditions and Right of Withdrawal will be sent to you again by email.

    (4) Order Process:

    You can submit a binding purchase offer (order) via the online shopping cart system.

    The goods intended for purchase are stored in the "shopping cart". You can use the corresponding button in the navigation bar to call up the "shopping cart" and make changes there at any time.

    After calling up the "Checkout" page and entering your personal data as well as the payment and shipping data, all order data are then displayed again on the order overview page.

    Before sending the order, you have the option of checking all the information again, editing it with the „Remove” or the „Edit” buttons (also using the "back" function of the internet browser) or canceling the purchase.

    By clicking the 'Complete Purchase' button on the Review and Pay page, you confirm that you have read the data protection regulations and accept the General Terms and Conditions as well as the Cancellation Policy.

    By sending the order via the corresponding "Complete Purchase" button, you submit a binding offer to us.

    After submitting your order from the website, you will receive an automatic email confirmation that we have received the offer. The order confirmation does not yet lead to the conclusion of a contract.

    If you do not receive the order confirmation within 5 business days, you are no longer bound by your order. In this case, please contact us by e-mail at info@belmil.de!

    The processing of the order and the transmission of all information required in connection with the conclusion of the contract takes place via e-mail, in some cases automatically. You must therefore ensure that the e-mail address you have given us is correct, that the receipt of the e-mails is technically guaranteed and, in particular, that it is not prevented by SPAM filters.

    After receiving your payment according to the chosen payment method, we will fulfill your order within 2 business days (see estimated shipping times here).

    Notes on delivery

    • Delays may occur if further communication with the customer about the order is necessary (about the order, shipping address, etc.).
    • If the delivery of the goods you have ordered is not possible, for example because the corresponding goods are not in stock, Be sCool will inform you immediately and immediately refund any consideration already received.
    • If not all of the ordered products are in stock, Be sCool is entitled to make partial deliveries at its own expense, provided this is reasonable for you and unless expressly agreed otherwise. 

    (3) The contract is concluded for the various payment methods as follows: 

    • Credit card as a payment method. You can enter your card details directly on the checkout interface, after selecting the appropriate payment method. We accept Wisa, Mastercard, Amex, Discovery, JCB credit cards.

    • PayPal as a payment method. You can use your PayPal account to purchase our products.

    After you click “Pay with PayPal,” you will be redirected to PayPal to safely complete your purchase. Shipping takes place after payment confirmation by PayPal.

    • If you pay in advance via bank transfer, Be sCool will accept your offer by requesting payment and providing our bank details. Please note, that it may take 1-2 business days to receive your payment.

    Unless otherwise stated for the individual payment methods, the payment claims from the concluded contract are due for payment immediately.

    If delivery is made to countries outside the European Union, additional costs for which we are not responsible may be incurred, such as customs duties, taxes or money transfer fees (bank transfer or exchange rate fees), which you must bear. 

    You have to bear the costs incurred for the money transfer (bank transfer or exchange rate fees) in cases where the delivery is made to an EU member state but the payment was made outside the European Union. 

    (4) By concluding the contract, you agree that Be sCool will send you invoices, credit notes, payment reminders exclusively in electronic form by email. 

    (5) The conclusion of the contract is subject to the condition that the goods are supplied by the respective supplier in good time and correctly in terms of type and quantity.


    If the goods are not available, but the customer can order it because of a technical error on the website, Be sCool Kft will immediately inform the customer of this. If the customer has already paid the purchase price and additional costs (e.g. shipping costs), these will be refunded by Be sCool Kft immediately within 5 business days. 

     

    4 RIGHT OF RETENTION, RESERVATION OF TITLE

    The goods remain Be sCool Kft.’s  property until the purchase price has been paid in full. Installment payment is not possible! 

     

    5 CANCELLATION POLICY

    • Right of return

    You have the right to withdraw from this contract within 14 days without giving any reason provided that the goods to be returned are in the same conditions as when received.

    The cancellation period shall be fourteen days from the day of receipt of the order.

    6 WARRANTY

    (1) The statutory warranty rights apply. Be sCool is liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB).

    (2) As a consumer, you are asked to check the item for completeness, obvious defects and transport damage immediately upon delivery and to inform us and the carrier of any complaints as soon as possible. If you do not comply, this has no effect on your statutory warranty claims.

    7 CHOICE OF LAW, PLACE OF PERFORMANCE, JURISDICTION

    (1) German law applies. For consumers, this choice of law only applies insofar as the protection provided by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn (principle of favourability).

    (2) The place of performance for all services arising from the business relationship with us and the place of jurisdiction is our registered office if you are not a consumer but a merchant, a legal entity under public law or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your domicile or habitual abode is not known at the time the action is filed. The authority to appeal to the court at another legal place of jurisdiction remains unaffected.

    (3) The provisions of the UN Sales Convention expressly do not apply.

    (4) The law of the Federal Republic of Germany applies, excluding the provisions of the UN Sales Convention (CISG).

    (5) The European Commission provides a platform for out-of-court online dispute resolution (OS platform), available at http://ec.europa.eu/consumers/odr/ .

    If the customer is a merchant, a legal entity under public law or a special fund under public law, the seller's place of jurisdiction for all disputes arising from the contractual relationship between the customer and the seller is the place of jurisdiction. This also applies if the customer does not have a general place of jurisdiction in Germany or the EU or if his place of residence or habitual abode is not known at the time the action is brought. 

     

    8 TERMS OF DELIVERY

    (2) The following delivery restrictions apply: Be sCool only delivers to customers from the countries with billing and shipping addresses listed under the following link: LINK a shippingről 

    (3) Be sCool will deliver ordered goods either itself or by third parties to the shipping address specified by the customer. The customer receives an automatic email notification with valid tracking code after the product has been dispatched. 

    (4) If you are a consumer, it is regulated by law that the risk of accidental loss and accidental deterioration of the item sold during shipment only passes to you when the goods are handed over to you, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not named by the contractor or another person responsible for carrying out the shipment. 

     

    9 DATA PROTECTION

    (1) Be sCool will collect, process and store all personal data provided by you (e.g. title, name, address, email address) exclusively in accordance with the provisions of German and European data protection law.

    (2) The data you provided are used to fulfill and process the order. Your data will be passed on to the logistic center where your order is fulfilled and the shipping company commissioned with the delivery if this is necessary for the delivery of the goods. To process payments, Be sCool passes your payment data on to the payment service providers.

    10 FINAL PROVISION

    (1) These general terms of use regulate the contractual relationship comprehensively and conclusively. Changes and additions must be made in writing to be effective. This also applies to the cancellation of this written form clause.

    (2) Should one of these general terms and conditions be ineffective, the rest of the contract remains effective. The relevant statutory provisions shall apply in place of the ineffective provision.
